How I confirmed that only Reliance ISP has blocked the site; I tried from Airtel ISP & the site opened, with no problems.
Blocking sites is not a new issue for Reliance cause we already witnessed blocking of file sharing sites post "Singham" & "Don 2" release. Even Reliance Big Pictures has issued a legal notice to a large torrent site to stop distributing "Singham". But the torrent site declined the offer stating that as the site is not in India it is not bound to follow or adhere terms from Indian Law. However the torrent site just put a appeal notice to not download "Singham" from their site but the real fact is that the movie download count was good.
What we think?
Blocking certain websites from ISP is ok if it is violating terms (such as ignoring DMCA or spreding Pirated contentes or adult contents or sensitive contents). But one thing we did not understand, Reliance Big Pictures is a concern of Reliance Group. So if Reliance Big Pictures had to forbid netizens (collective name used for Internet using citizens) from downloading their produced stuffs so why don't they directly place a legal notice to the websites that are violating the policy. They can surely put a charge on them and compel them to remove the contents by using the laws of the country from where the site is being operated. It is possible to take down as we have seen the example of MegaUpload shut by FBI. And also the sites have their DMCA abiding pages which clearly states that "if you are the original content owner then provide us with legal & original documents of your authority. We will remove your copyrighted content from our site".
One may now say that
"Ok I understood what you said, but what you will say about the previous torrent site example?"
Answer to this: Most P2P sites does not abide by this rules & they also did the same. But the website Songs.PK is not a P2P site & may be charged legally.
Some questions to Reliance:
- If Department of Telecom (DoT) issued a ban to the websites then why other ISP's of India did not block the site? Or it is a special order only passe for Reliance ISP's?
- If DoT didn't order this then why using a DoT notice on the page?
- Why Reliance blocked the site like an unskillful. Why you blocked www.songs.pk & why not blocked songs.pk. (If anyone types "www.songs.pk" the site will not open but if anyone types only "songs.pk" without the "www" the site is working correctly).
We will now wait & watch (cause nothing can be done) if Reliance is going to be a dictator ISP like China or any message or notice come from them.
